Terms and Conditions
1. All business undertaken by J.A.B Design shall be subject to these conditions. These conditions shall be incorporated in the contract to the exclusion of any terms or conditions stipulated or referred to by the client. By payment of deposit clients are agreeing to the following terms and conditions.
2. Copyrights of all drawings will remain the property of J.A.B Design.
3. Cancellation/Termination of the employment of JAB Design services; Stage 1 deposits, post Survey will Not be Refundable.
4. The remaining balance must be paid within 5 days upon the completion of drawings from J.A.B Design. Drawings will not be submitted to building control or planning until the outstanding balance is paid.
5. Upon payment of the remaining balance in accordance with paragraph 3, J.A.B Design grants the client an irrevocable, non-exclusive, non-terminable and royalty-free licence to make full use of the materials prepared by J.A.B Design, or on its behalf. Such materials to be used for the sole purpose of carrying out the building works to enable completion of the project as agreed between J.A.B
Design and the Client, each acting reasonably.”
6. J.A.B Design is not responsible in any way for services recommended by them involving a third- party company or service.
7. Additional fees may be incurred when –
- More than one option is requested (unless clearly stated in the quote)
- Additional Site Visits are requested over and above the agreed number of visits unless we are instructed to oversee or manage the project. Site visits cost £125+VAT
- Street View Design Drawings are required by Planning or requested by the client
- Additional Floor Space (making the extension bigger) is requested
- Clients requesting changes once planning applications has been submitted (not changes requested by planning as these are included within our initial fee)
- The client requests extra schemes / options
- Any printing over A3 size is requested
- Delays are caused by the client
- A redesign to meet budget costs where budget limitations were not mentioned by the client in the initial brief.
- Reimbursable expenses. These shall include but not be limited to: printing, reproduction, bulk copying, photographic services, travel expenses, out of pocket expenses etc
- In accordance with The Late Payment of Commercial Debt Act 1998, please note that interest may be added 8% above The Bank of England base rate, if the invoice is not settled within five (5) days of the invoice date. (In the event that payment is not forthcoming within the prescribed 7 days, JAB Design retain the right to stop work on any outstanding project for that client.)
- A surcharge of 15% will be added to the overall fee for clients using Local Authority Building Control as opposed to an agreed private building inspector
- Additional work requested by the client that is not requested in the original brief
- Re-submission of a planning application is necessary (£150)
- Subsequent 3D Images following Stage 1(Initial Drawings & Survey)
- If Party Wall Surveyors require further detailed drawings to qualify Party Wall agreements the client will be charged an hourly rate of £75 per hour all prices exclude VAT
8. Plans may be altered due to structural changes made by 3rd Parties.
9. Client’s choosing to use their Local Authority Building Control must not commence work until the plan check has been approved.
10. It shall be the responsibility of the client to ensure that all requirements applicable in this contract, whether statutory, regulatory, municipal and for otherwise howsoever are duly complied with.
11. Where initial drawings are quoted payment is due 5 days following the first draft of drawings. Any amendments will be completed within the 7 days period, unless otherwise agreed by both parties.
12. Parameters for structural drawings and calculations must be agreed by myself.
13. Unless specified in the quote it is up to the builder to submit the application to release the conditions of planning for extensions.
14. A £110+VAT admin cost will be charged if a Build Over Agreement is required (details of a Build Over Agreement can be found at the end of these Terms).
15. Applications for Release of Conditions will be charged at the following: Extensions £225; New Builds (Single Dwellings) TBA; Developments / Commercial applications – TBA (varies depending on size) all prices exclude VAT
16. Additional Costs may be incurred when additional 3D Visuals are requested over and above the following – Single Storey Extensions – 5 Visuals, Double Storey Extensions – 5 – 10 Visuals, New Build Dwellings 10 – 15 Visuals. Clients are given the opportunity to view a walk-through version from the office.
17. Change to the design following Planning Permission being granted requires a fee charged at an hourly rate of £50.00 per hour, all prices exclude VAT.
18. Over three revisions of the initial design by the client will incur an additional cost of a third of the initial design cost.
19. Any changes to drawings After the Building Regulation Drawings are submitted to the Client will be charged additionally, cost to be £50 + VAT per hour.
20. Jab Design reserve the right to publish on social media or any other media their designs or work produced for clients.
21. If JAB Design are asked by yourselves the client (both verbally or written) to send out drawings for quotation for third party services, such as building quotes, building control quotes, structural drawings quotes, you agree for us to share your contact details.
Advisory to Clients: Do not carry out any building work without full building regulations approval, any works carried out prior to this will be at the risk of the builder & property owner.
Party wall act 1996 (further details to be found on our website)
A notice of intention to work must be given to all the affected neighbours if the work involves:
· Work on an existing wall shared with another property
· Building on the boundary with another property
· Excavating near a neighbouring building.
Full details of the proposal are to be made available to the neighbours & a clear statement of notice under the party wall act (1996) be served 2 months before the planned date of works.
Note: Boundary ownerships and their exact locations are the responsibility of the client and are to be determined / agreed with the contractor / neighbours prior to the commencement of any building works are not the responsibility of the authors of this drawing. No dimensions are to be scaled from the drawings only exact dimensions are to be taken; any discrepancies are to be flagged up to the designer immediately
Build Over agreements
What is a build over agreement?
A build over agreement is required when the proposed building/extension is built over or within 3m of a communal asset (i.e sewer) This application is made to the Asset Management Department of your local sewerage company and requires a fee which relates to the diameter of the sewer line.

You must sign up with a Building Control company 5 days prior to the build commences.
